Mountain Crossing LLC – Participation Statement

Mountain Biking can be an inherently dangerous activity by design. Mountain Crossing LLC will provide you with a guided ride in an appropriately safe working environment and provide you with a fully Qualified Guide. Clients will not be placed under any pressure to perform skills if they do not feel comfortable in doing so. All clients are strongly advised to take out their own Personal Accident Insurance and 3rd party Liability Insurance; we also advise to check that your policy covers adventure activities. Mountain Crossing LLC will not accept any liability for injuries or illness caused whilst attending our activities providing that we are not directly at fault.

Signed Agreement on Rider Assumption of Risk & Waiver of Liability: All clients sign and agree that they participate on the ride at their own risk. Mountain Crossing LLC takes all reasonable steps to establish as safe an environment as possible through risk assessment processes before and during the activities. All clients acknowledge that they know of no personal disability or medical condition, physical or mental, which may affect their ability to take part in the ride.

Mountain Bikes: Clients are to ensure they arrive with an appropriate, well maintained fully serviceable mountain bike fit for technical off road trails.

Personal Protective Equipment: All clients must wear the minimum Personal Protection Equipment that includes a Mountain Bike Helmet, Cycling Glasses and Gloves. Knee Pads and Elbow Pads can be worn if required. A backpack is to be used to carry spare clothing, food, water and equipment. We strongly advised that clients also wear appropriate warm/breathable/comfortable clothing designed for General Sports or specific Mountain Bike use. Clients are to be aware that we will be riding in a wild and hostile environment where the weather can change suddenly and without warning.

Food and Water: All clients are to ensure they bring enough Food and Water to last them throughout the day. Our day rides last 4 to 8 hours. Mountain Biking can be physically arduous and combined with potential adverse weather can reduce energy levels significantly.

Spares: Clients are to bring their own spare inner tubes, tire levers, hand pump, and spare compatible parts for their bikes. All other emergency spares will be provided by Mountain Crossing LLC as required.

Personal Performance Limits: Clients should ride within their own riding experience and limits. Mountain Crossing LLC accepts no liability for any loss, damage or injury to persons or property who are participating on a ride. Anybody deemed to be compromising the safety of other clients and or Guides will be asked to dismount the bike and escorted to a safe place for leaving.

Payment Terms: Payment is required in full within 7 days from the date of the invoice. Once payment is received you will receive the booking confirmation.

Cancellation by Mountain Crossing LLC: Mountain Crossing LLC has the right to cancel rides at any time when the well being and safety of clients is compromised due to riding conditions being unacceptable or for any other circumstances which are outside Mountain Crossing LLC’s control. A full refund or alternative ride will be given in all circumstances.

Cancellation by the Client: Cancellation with more than fourteen days prior to the ride start date will result in a loss of 20% of full course fees (i.e. 80% of your fee will be returned) A cancellation less than fourteen days to the course start date will result in Mountain Crossing LLC retaining 100% of the course fees.
